The receipt no. had SRC***** in it and when i looked it up online i saw a note stating " your applicaiton is with our Texas Center". I did send it to NSC on Jul 2.
I understand that. What I wanted to know was what number you have? SRC or LIN? And also to confirm, if it was cashed by TSC? and not the case that it was cashed by NSC and then scheduled to be transfer to TSC?
As you had said "I think it got transferred to TSC". You mean it really got? or you think?

Non-compete are notoriously hard to implement.
Only if it is too restrictive. this case is pretty straightforward and simple. employee is directly hitting the employer's revenues.

I dont have access to the certified labor copy , I am just wondering if we need it for AC21 purposes. I am not sure how to get it from my desi employer/ desi lawyer. I have a job offer with a fortune 200 company which is willing to do H1b transfer/extension so I am opting for H1b instead of EAD. I am pretty sure about the job description will satisfy the same/similar test.
Is the job title and job description mentioned on the labor cert? Mine is a pre perm case. Is it good to have copy of labor cert for AC21?

EAD application mailed to USCIS on 21 May 2008
There was one RFE - USCIS requesed two photos. They were shipped on July 2nd.
I have not received any FP Notice. (strange)

Like poste din another thread, I called USCIS customer service today to speak about EAD application that has been pending for 60+ days. The Phone rep told that he cannot give me any information about any cases right now since their "system is down". I asked for clarificationand he said that cases are still being processed but the system used to view status is down. Not sure what that means.
Not sure if this will cause any more delays .............. I need EAD renewed by Sept since my current one expires then
Also anybody has any ideas on what "Plan B" might be if renewal is further delayed by sept?

To be more accurate, it is not porting I-140, it is retaining your old priority date, and using it with your new I-140 petition.
When you move, your new company will have to start the GC process from the begining - Labor, I-140. It is just that when they file your new I-140, you will have to provide a copy of your old one and request to keep the old priority date.
I think there are some requirements to get this right - one of them being your job classification should be the same. There is a thread on this subject somewhere on this forum, you can dig it out and ask questions there.

I myself will not support for skill Bill in current form. Too much H1b numbers will not only create a problem for US citizens it will also for current H1bs as well future H1bs. That 20% automatic adjustment and exemption for Cap for MS persons will increase supply and it will be tough to find a job if too many people are in the market. There are abundant jobs in India. Let people wait in India for 1 or 2 years to come here. Sustained immigration without increasing unemployment is better for US as well as potential immigrants. Otherwise Hate will increase. It may be easy to talk Capitalism and fittest will survive. When those people talking will be unemployed for more than 6 months with kids in the family will realise the truth. In the Forum most of the people are young and they did not face any issue other than Green card.
But speed with which Corporations and Lawyers are working the Skill bill be passed in current form soon. We will wait and see after 3 years after increasing H1B. My prediction is Limited increase in H1 with Moderate increase in GC numbers will solve the problem for all the gc waiting people without big reaction from anti immigrants and that will boost sustained immigration.

We have a legitimate, common sense and good cause on our side.
In this time of globalization and increased competition, do the senators/congressmen really want this country to lose half a million highly skilled, experienced and trained-in-America-for-years people to India and China, and to Europe and canada?
If they put 'holds' or refuse to take up our cause after they are fully aware of our situation, then atleast you know that they are doing it out of racism and/or narrow political and parochial motives.
But unless we make our situation known to these guys, we shouldn't really blame them.......Also, those with kids born in America might get more of a response from the legislators.
It is pathetic that there is a thread from NJ, and the guy is begging people to join/respond; it is mind-boggling that there are only seven members from NJ. It is absolutely ridiculous that the only two responses on the 'Calling all Wisconsin members' have been from myself, and another person. And that other person is from Illinois......

I only took Bank Statements. In my case they did not even ask to see those.
Actually in the landing paper there is a place where teh officer needs to sign of funds as well.
some places officers dont ask for it and in other places like rainbow bridge they do ask for it. However it is justa small formality...i just tooka printout of the online statement and that was fine with them.

My husband called USCIS today to check if they have correct address on file and alas they had old address. When we moved after filing for I-485/EAD/AP, we changed the address in Oct and also after we received receipt notices in Jan. We received EAD/AP/Finger printing notices at the present address for all three of us and now they are saying they had old address on my husband's I485 only, great!!!
They were not sure where the card/welcome notice/approval notice were mailed, to my old address or the attorney. Will check with the attorney today, if not what is the procedure as the card will return back. Thanks in advance.

hope that means they are willing to talk about giving EAD. If we get EAD all the lawsuits will be withdrawn. The law does not say AOS applications should not be accepted when there are no visa numbers available, the law only says AOS cannot be approved when visa numbers are not available. USCIS internal regulations says they will not accept AOS applications when priority date is not current. by now its quite apparent that USCIS has broken a lot of there own internal regulations just to make sure the visa numbers are used up before july 2 2007. Then can easily accomodate the EAD for july filers. It all depends upon the pressure exerted on USCIS and DOS
My interpretation of "But we're prepared to talk to people about what happened here." is "We know what we did. And if you take us to court, we are prepared to talk our way out of this fiasco."
Between the Iraq war and tensions in the mid-East, she will actually welcome such easy battles. This administration is extremely smug.
