I am on F1 too and i recently went to India after we had applied for i-485. I used my AP and when i had asked in my Office of International education I was told that the moment i applied for i485 my F1 was cancelled.

In this circumstance it is fine to file an H-1 petition while the L-1B appeal is pending.
He is out of status right now. Won't that impact H-1B Change of Status? He may get COS without I-94 attached and that may require him to travel outside USA to get visa stamp.
My understanding is that beneficiary must be in-status at the time of filing for change of status.
Thanks!

FWIK, EAD is just a work permit. It does not give you any status. So you have your H4 to keep your status and EAD to work.

Hi,
I am working in US on L1 and my company would start my green card filling in next few months.
I also have valid H1B pettion stamped and can switch to H1B which would mean that I can work freely here at US.
But many of my friends told me that green card processing is faster on L1.
I am not able to make decision whether I should continue working on L1 or change my status to H1 to get better hike and more opportunity.
Pls can anyone tell me which would be wise choice. Is green card processing for L1 visa is faster?
Thanks in advance.
~Greeta
GC in L1 is not faster than H1. Its just that L1-As are typically multinational managers who qualify for EB1, and H1s typically are engineers/worker-bees who qualify for the longer EB2/EB3 Process. So first find out what your category is going to be, EB1 or one of the other two.
If you qualify for EB1, your GC process will be fast (~6 months), if its EB2 or EB3, hunker down for a long (5?10 years?) wait. This is irrespective of whether you are in L1 Or H1.
advantages of H1
- can be extended indefinately past 6 years in 1-3 year increments; once you have a GC going (LC >365 days old or I-140 approved).
- can change employers in the US.
advantages of L1
- if your spouse is on L2, he/she can get an EAD and work.
so main issues with your current status of L1:
- If you have not filed your 485 within your L1 time, you need to change status to something else or return to home country. You cant get the extensions that you can get with H1.
- if you lose your job, if you already had an H1 In the past you can move to that status, otherwise you need to go to home country and then get lucky in next years lottery.
- there are no salary restrictions, so the employer can potentially legally underpay you. With H1 you must atleast be paid the prevailing wage.
So unless you have a spouse that is currently on an L2-EAD, I would think moving to H1 makes more sense. (time in L1 counts agianst your time for H1 and vice-versa)

Yes please explain that better.
Some grammar/spellings gremlins conspired to mash up what I believe was an illuminating post in the making.
No offence meant or intended, I suggest a repost of the one by Mark.:)
I am trying to figure out how much latency is to be expected in allotment of a GC for a case whose PD comes current sometime in the future and the processing date at whose service center too is later than the application date for the case at the time the PD comes current.
Thanks and best regards.

I have been looking at a lot of posts on this Rajiv Khannas immigrationportal and there seems to be a lot of confusion about who is legit and really interested in our cause and who is faking it to collect money and run with it.
I agree that its hard to trust someone youve never met and get involved in discussing strategy, participate etc let alone cut a check of $50.
LET ME BE CLEAR ABOUT SOMETHING HERE:
I have no vested interested in diverting people from any website to any website and re-divert people from one organization to another. If you know someone who works for you and you trust fine. Go with it.
I personally am really really mad at the retrogression going on in EB GC. I applied for my Labor in Sept 2004. Got it approved in June 2005. I have been sitting on my hands since. I-140 is in process. With the speed things are going now, I will have GC no sooner than 6 years.
AND I AM JUST MAD THAT AFTER ALL THESE YEARSI CANT EVEN APPLY FOR I-485.
Then I came across this website on the morning of 31st DEC and then looked at immigrationvoice.org. Talked to a couple of people on the phone from immigrationvoice.org. I am going to post tomorrows agenda of conference call RIGHT HERE.
If you want to participate in this call, either to suggest ideas or to check out if we are legit or not, just register on immigrationvoice.org (ITS FREE) and send an email with your phone numbers (its free) so that we can verify that you are legit and not a heckler who is going to disrupt the conference call.
If you still are not convinced and trust someone else, go with it.
Another thingimmigrationvoice.org is only 4 days old. Bear with us if we are not perfect. But we will surely be fully functional with all the bells and whistles before you know it.
AGENDA for tomorrows conference call:
A) GENERATE PUBLICITY ABOUT IMMIGRATIONVOICE.ORG.
Spread the word that this website is going to consolidate all efforts to have provisions to eliminate retrogression. Convince people that immigrationvoice.org is legit and operated by people WHO DONT HAVE GC/CITIZENSHIP and are waiting in line for GC.
B) GATHER FACTS FROM BOOKS, AUTHENTIC SOURCES.
There are at least 3 books out there that deal with exodus of talent from this country either due to cultural reasons or due to hostile immigration policy. These books claim that there is competition for talent out there (Talent being people like H1Bs, researchers, engineers etc) between US and other countries and USA IS LOSING. Check out Flight Capital by David Heenan and The flight of the creative class by Richard Florida.
We want those facts to convince congress that eliminating retrogression is not only in an immigrants interest, BUT IN THE INTEREST OF AN AVERAGE AMERICAN EMPLOYER. We are not looking for a frigging charity or a handout. We are not saying O dear congress, give us a green card and we shall be eternally thankful to thy congress. That is a wrong strategy and an unnecessary one.We are legal immigrants. We are not looking for amnesty. Just a fair deal for people who stand in line for GC and play by the rules, pay their taxes, protect their status and obey the rule of the law.
We are looking to consolidate an already existing symbiotic relationship. A win-win situation.
C) INFLUENCE CONGRESS.
By this time, anyone who is not living under a rock knows that there is a comprehensive immigration bill coming up before congress. The bill will be introduced, debated and most likely passed. The question is whether or not the retrogression relief measures are included or thrown out.
We need to plan a strategy to
1) Convince congress with FACTS and NUMBERS how the current H1B program has given an edge to US employers and contributed to the society in general and how it is in Americas interest to put this symbiotic relationship on a solid ground by speeding up Employment based green card.
2) To work with congress, devise a strategy to meet them in person, as many as possible. Create an A-list of senators and congressmen who have the most say in committees and sub-committee hearings. We would work to communicate and convince these men first and then have a message machine to send a blanket message to ALL.
If you are still not convinced and go with someone else or go with do-nothing-and-hope-for-best strategy, then go ahead.
OTHERWISE register and participate. And you wont lose a dime by doing that.

If you do h1 transfer then the advantage is incase your 485 application gets denied for any reason you will still be in legal status ,where as in case you use EAD and any 485 denial you will be out of status immediately.

US needs EB1 and Ph.Ds
Others not contribute as much
Actually US needs innovation and good talent. Not all PhD are that extra ordinary.
One goes through the motions of adding incremental knowledge (that quality also depends of the reputation of the university). Most PhDs struggle from one post doc to another.
Piled Higher and Deeper - Wikipedia, the free encyclopedia (http://en.wikipedia.org/wiki/Piled_Higher_and_Deeper)
PS: I mylelf dropped out of PhD like many of my friends. My experience was that
only a few PhD students were doing "good" and relevant research. Rest were very acedemic in nature and all about working on questionable commercial value of DARPA and NSF grants.

Thanks to all for your valuble information, hope, sertasheep, miguy. Your information is very educative.
Now, this just proves a fact that it is relatively easier to get good physician jobs in the US after completing residency, even on a h1b, whereas if we go out to different countries, a lot of issues may arise. The next option would be Canada and for Indian nationals it would be India (private hospitals and practice)
So retrogression is a big concern for physicians and is impacting physician careers. I recommend all IV physician members must come forward and educate all those h1b physicians/ residents/fellows etc.. who are still ignorant of what they have got into, believe me, a lot of people don't know what is going on and they still think things are going fine.

I hope it doesn't affect Employee (original labor) who have left GC employer using AC-21 with approved I-140 and after 180 days.
This interpretation is game changer for life of many EB immigrants. It should be implemented for going forward but at least should not affect those who used it by the interpretation of that time.

Gotcha..!! Thanks..
No I dont plan to invoke AC21 anytime soon.
Your assumptions are exactly right. Do you plan to invoke AC21 in near future? I think if you switch to a company who is willing to transfer your H1B, you can transfer it as well. This is what my attorney told me some time back when I was in your stage and can still avoid using EAD.
The purpose of maintaining the backup is for safety. Even if your 485 denied, you can still have some time period left on your H1 and can look for other alternative avenues to be here legally and can restart your GC process as well. Without this H1 backup, you have a very little time to do so.
(Though I got GC now, my H1 is valid till end of 2010 :) )

I think we need the list of new congress men/ women to call as part of phase 4 of the campaign.
Concentrate on your local lawmakers and CHC members. Sometime back, IV experts told us that we need more republican support too so concentrate on republican lawmakers too.

Two Days Left for Submission of Comments to DOL on Substitution Elimination Proposed Rule....
IV Members, what do you folks think?
I suggest elimination of labour substitution is good for many of us and also help avoid people getting into the GC line in front of many people waiting for years, Many companies and attorney's suggest the labour substituion must be allowed, but I think the opposite... Any comments on this

You guys probably verified this already but -
if you read (the intended) Sec 218D (amendment to the INA) and Sec 602 of S.2454, they do not exclude legal aliens.
All that is required under 218D is that a person must have been in the US on or before Jan 7, 2004 and have proof of employment.
Why shouldn't a legal nonimmigrant visa holder apply for AOS under 218D?
What am I missing here?
you are missing the whole point: you should've been undocumented on or before Jan 7th 2004
